Focus Diagnostics, Inc. Corporate Privacy Notice

Purpose
The Corporate Privacy Notice informs clients and patients of Focus Diagnostics, Inc. privacy practices. The notice describes the use, disclosure, and access of protected health information, which also serves as an internal workforce policy.

Scope
The terms of this Notice of Privacy Practices apply to Focus Diagnostics, Inc. and all its employees operating as a clinical health care provider as well as an anti-infectious surveillance service and diagnostic manufacturing division. The members of this facility work and practice at 5785 Corporate Avenue, Cypress, CA 90630 and at 13665 Dulles Technology Drive, Herndon, VA 20171-4603. Protected health information will only be disclosed as a necessary function to carry out treatment, health operations, billing and/or other health functions as permitted by law.

Policy
By law, Focus Diagnostics, Inc. is required to implement appropriate administrative, technical, and physical safeguards to reasonably prevent any intentional or unintentional use or disclosure of protected health information that violates HIPAA regulations.

In addition, Focus is required to make reasonable efforts to exercise minimum necessary practices that limit the request for, or the use and disclosure of, protected health information for treatment, payment or billing purposes. Disclosure or use of protected health information outside of treatment, payment and health care operation purposes require the one or all of the following; the patient's written authorization; the covered entity's written authorization; and/or the approval from the Compliance Officer and HIPAA committee. Protected health information may be used or disclosed if the data has been delimited for public health or research purposes.

Any access to protected health information must be related to job function. Any employee found to intentionally access protected health information outside the job function is prohibited and may be immediately terminated.

Focus Diagnostics, Inc. also has a duty to provide clients and patients with notice of the company's legal obligations and privacy practices with respect to their protected health information.

Focus is required to abide by the terms of these notices so long as they remain in effect. Focus' privacy policy may change to reflect any updates in the law. Privacy Notice

Purpose
The LSP Privacy Notice informs clients and patients of Focus Diagnostics, Inc. privacy practices. The notice describes the use, disclosure, and access of protected health information, which also serves as an internal workforce policy.

Scope
The terms of this Notice of Privacy Practices apply to Focus Diagnostics, Inc. and all its employees operating as a clinical laboratory services as well as the Diagnostics Divisions of Focus Diagnostics, Inc. The members of clinical laboratory services operate at 5785 Corporate Avenue, Cypress, CA 90630. All of the entities and persons listed will limit the use and disclosure of protected health information of clients and patients as minimum necessary to carry out treatment, payment and health care operations as permitted by law.

Policy
Focus Diagnostics, Inc. is required by law to maintain the privacy of the clients' and patients' protected health information. Focus Diagnostics is also required to provide notice of legal duties and the privacy practices of clients' and patients' protected health information. Employees are required to abide by the terms of this Notice so long as it remains in effect. Focus reserves the right to change the terms of this Notice of Privacy Practices whenever necessary to reflect changes in the law.

  • Uses And Disclosures Of Patient's Protected Health Information (PHI) for Treatment
    Under HIPAA and CLIA, 42 USC. 263a and 42 CFR part 493, Focus Diagnostics, Inc. will only disclose protected health information to the authorized person or entity. Patients may request their health information from their doctor's office.
  • Uses and Disclosures for Payment
    Focus Diagnostics, Inc. will make uses and disclosures of protected health information as necessary for the following payment purposes:
    • Focus may forward the patient's medical procedures and treatment to their insurance company to arrange payment for the services provided,
    • Focus may use protected health information to prepare a bill that will be sent to the patient or to the person responsible for the payment.
  • Uses and Disclosures for Health Care Operations
    Focus Diagnostics, Inc. will use and disclose protected health information as necessary. Uses or disclosures without authorization are permitted by law for health care operations, which include referral treatment services, clinical improvement, professional peer review, business management, accreditation and licensing, etc. Client's and patient's protected health information may be also be used and disclosed for improving the clinical treatment and care of patients. Protected health information may be released to another health care facility or professional who provides treatment for the patient but is not affiliated with Focus Diagnostics, Inc.
  • Business Associates
    Certain aspects and components of the services are performed through contracts with outside persons or organizations, such as auditing, accreditation, legal services, etc. As a necessary part of the health care operations, client's and patient's protected health information may be disclosed to other business associates. However, Focus Diagnostics requires all business associates to appropriately safeguard the privacy of the information.
  • Other Uses and Disclosures
    Focus Diagnostics, Inc. is permitted or required by law to make other uses and disclosures of protected health information without client's and patient's consent or authorization. Protected health information may be released for the following reasons:
    • for any purpose required by law;
    • for public health activities such as required reporting of disease, injury, birth, death, and for required public health investigations;
    • to the Food and Drug Administration if necessary to report adverse events, product defects or to participate in product recalls;
    • if required by law to a government oversight agency conduction audits, investigations, or civil or criminal proceedings;
    • if required to do so by a court or administrative ordered subpoena or discovery request; in most cases the client or patient will have notice of such release;
      to coroners and/or funeral directors consistent with law;
    • if necessary, to arrange an organ or tissue donation from the patient or a transplant for the patient;
      if the patient is a member of the military as required by armed forces services; Focus may also release protected health information if necessary for national security or intelligence activities; and
    • to workers' compensation agencies, if necessary, for workers' compensation benefit determination.
  • Complaints
    If any client or patient believes their privacy rights have been violated, a complaint can be filed with Client Services at 1-800-445-4032 or by sending a letter to: Focus Diagnostics, Inc. Attention: Client Services, 5785 Corporate Avenue, Cypress, Ca 90630. Client Services will maintain records of complaints. Clients, patients, or employees may also file a complaint with the Secretary of the US Department of Health and Human Services in Washington D.C. in writing within 180 days of the violation. In accordance to the law, Focus Diagnostics' Non-retaliation policy prohibits retaliation against anyone who files a complaint.

Focus Diagnostics, Inc. Anti-Infective Services Division Privacy Notice

Purpose
This notice describes how protected health information may be used, disclosed and how you can get access to this information. This notice describes how protected health information may be used, disclosed and accessed; this policy has dual purposes. First it serves to notify clients of Focus Diagnostics' privacy practices. Second, the policy will be used internally for training purposes. Please review it carefully.

Scope
The terms of this Notice of Privacy Practices apply to Focus Diagnostics, Inc. and all its employees operating as the Anti-Infective Services Divisions of Focus Diagnostics, Inc. The members of this division work and practice at 13665 Dulles Technology Dr., Herndon, VA 20171 . All of the entities and persons listed will limit the use and disclosure of protected health information of patients as minimum necessary to carry out treatment, payment and health care operations as permitted by law.

Procedure
We are required by law to maintain the privacy of protected health information, provide clients with notice of our legal duties and privacy practices with respect to their protected health information. We are required to abide by the terms of this Notice so long as it remains in effect. We reserve the right to change the terms of this Notice of Privacy Practices as necessary and to make the new Notice effective for all protected health information maintained by us.   • Uses And Disclosures Of Your Protected Health Information
    Under CLIA , 42 USC. 263a, 164 and 42 CFR part 493, and 45 CFR Parts 160 and 164, Anti-Infective Division does not request protected health information from our clients. We may receive protected health information from our clients for research or public health purposes, however we have a policy implemented to another health care facility or professional who is not affiliated with our organization but who is or will be providing treatment to the patient.
  • Business Associates
    Certain aspects and components of our services are performed through contracts with outside persons or organizations, such as auditing, accreditation, legal services, etc. At times it may be necessary for us to provide certain items of patient's protected health information to other business associates as part of our health care operations. In all cases, we require these business associates to appropriately safeguard the privacy of the information.
  • Other Uses and Disclosures
    We are permitted or required by law to make certain other uses and disclosures of protected health information without patient consent or authorization.
    We may release protected health information for any purpose required by law;
    • We may release protected health information for public health activities such as required reporting of disease, injury, birth , death, and for required public health investigations;

You may also file a complaint with the Secretary of the US Department of Health and Human Services in Washington D.C. in writing within 180 days of a violation of your rights. There will be no retaliation for filing a complaint.
